SMS Terms & Conditions

Nest Healthcare, Inc. and its affiliates (“Nest Health,” “Nest,” “us,” or “our”) offer optional messaging via Short Message Service (SMS) and Multimedia Messaging Service (MMS) (collectively, “text messages” or “texts”) through the Nest Health Texting Programs (“Program(s)”). The Programs support patient care, health plan benefit information, and wellness reminders. By opting in to any Nest Health Texting Program, you agree to these SMS Terms & Conditions (“SMS Terms”) and our Privacy Policy. By enrolling in a Program, you provide your prior express consent to receive recurring text messages from Nest Health at the mobile number you provided. These messages may be sent using automated technology, including an automatic telephone dialing system or similar technology. For Programs that include marketing or promotional content, you provide your prior express consent to receive such messages, as permitted by applicable law.

“You” and “your” refer to the adult individual who enrolls in a Nest Health Texting Program and is authorized to receive text messages on behalf of the applicable patient.

Participation is voluntary. Consent to receive text messages is not a condition of receiving care or services from Nest Health.

1. SMS Program Overview

Nest may offer the following text messaging programs:

  • Nest Health Care & Appointment Alerts (AZ)

  • Nest Health Informational & Promotional Alerts (AZ)

  • Nest Health Care & Appointment Alerts (LA)

  • Nest Health Informational & Promotional Alerts (LA)

Program messages may include appointment confirmations and reminders, scheduling updates, care coordination or case-management notifications, information about plan-included health services, and seasonal or value-add wellness reminders. Certain Programs (including “Informational & Promotional Alerts”) may also include marketing or promotional messages that encourage the use of Nest Health services or related offerings.

Your consent applies only to the Program(s) you choose to join. Your consent is provided at the time you enroll in a Program through a Nest Health-authorized enrollment method (such as a form, checkbox, or other opt-in process) and applies only to the mobile number you provide.

2. Eligibility & Intended Recipients

The Programs are offered to and intended for use only by individuals aged 18 years or older who reside in the United States or its territories.

Text messages may support care coordination, scheduling, and benefits related to children or other dependents, but all SMS communications are sent only to an adult recipient who is authorized to receive communications on behalf of the patient.

By enrolling in a Nest Health Texting Program, you represent and warrant that you are at least 18 years of age, that the United States-based mobile number provided belongs to you, that you are authorized to receive text messages related to the applicable patient’s care, and that you consent to receive text messages from Nest Health at that mobile number, including messages sent using automated technology as described in these SMS Terms.

If you do not meet these requirements, you must not participate in the Program and should reply STOP to opt out.

3. Message Frequency

Nest will send text messages at varying frequencies. Message frequency may vary based on participation and care needs. Messages may be sent on a recurring basis.

4. Message & Data Rates

Nest does not charge for text messages. However, message and data rates may apply depending on your mobile carrier plan.

5. Carrier Limitations

Delivery of text messages is not guaranteed and may depend on network availability. Carriers are not liable for delayed or undelivered messages. Supported carriers may change at any time.

6. Opt-Out & Help

You may opt out of any Nest Health Texting Program at any time by replying STOP to the sending number. After your request, you will receive a confirmation message, and you will no longer receive texts from that Program unless you opt in again through a Nest-authorized enrollment channel. Consent to receive text messages is not required as a condition of purchasing or receiving any goods or services from Nest Health.

7. Privacy & Security

Please be aware:

  • SMS messages are not encrypted

  • Messages may be accessible to third parties with access to your device, carrier account, or messaging services

  • Messages may contain limited personal or healthcare-related information

  • Links included in messages may require secure login

Nest limits SMS content to the minimum necessary, in accordance with HIPAA and Nest policies. Nest cannot guarantee the security, integrity, or authenticity of text messages, which may be intercepted, tampered with, or lost in transit.

Notify Nest immediately if your mobile number changes. Nest is not responsible for messages sent to a number that you failed to update, or messages sent after a number changes ownership without your knowledge.

If you provide consent to receive text messages, such consent will apply even if your number appears on a federal or state Do Not Call registry, to the extent permitted by applicable law..

8. Changes to These Terms

Nest may update or modify these SMS Terms at any time. Continued participation after updates constitutes acceptance of the revised terms.
